Welcome to Yacht Junky. These Terms of Service ("Terms") govern your access to and use of the Yacht Junky website and platform ("Platform"). By creating an account, listing a boat, making an enquiry, or otherwise using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.
Yacht Junky is operated by Yacht Junky [registered company name and number to be inserted if applicable], based in the United Kingdom ("Yacht Junky", "we", "us", "our"). The Platform is intended for use within the United Kingdom.
1. What Yacht Junky Is
Yacht Junky is an online marketplace that connects people who want to sell boats with people who want to buy them. We provide the platform on which listings are published and through which buyers and sellers can contact one another.
We are not a party to any sale. Yacht Junky does not buy, sell, own, inspect, broker, or take possession of any boat listed on the Platform. We are not a broker, dealer, agent, surveyor, or auctioneer. Any transaction that results from a connection made on the Platform is solely between the buyer and the seller.
2. No Involvement in Transactions
All negotiations, agreements, payments, inspections, surveys, transfers of ownership, and any other aspect of a boat sale take place directly between the buyer and the seller, away from the Platform.
Yacht Junky does not process, hold, or handle any payment between buyers and sellers.
We do not verify the condition, seaworthiness, ownership, history, or value of any boat.
We do not guarantee that any listing is accurate, complete, or current.
We do not guarantee that any buyer or seller will complete a transaction, act in good faith, or be who they claim to be.
You are responsible for carrying out your own due diligence before entering into any transaction. This includes verifying ownership, arranging independent inspections or surveys, confirming the accuracy of all details, and using appropriate contracts and payment methods.
3. Eligibility and Accounts
To list a boat or save listings, you must create an account. By registering, you confirm that:
You are at least 18 years old.
The information you provide is accurate and kept up to date.
You are responsible for keeping your login details secure and for all activity under your account.
You must notify us promptly if you believe your account has been accessed without your permission. We may suspend or close accounts that breach these Terms.
4. Listing a Boat
When you publish a listing, you confirm that:
You are the owner of the boat, or are authorised by the owner to sell it.
All details, descriptions, specifications, photographs, and prices are accurate and not misleading.
The boat is not stolen, subject to undisclosed finance or legal claims, or otherwise prohibited from sale.
Your listing complies with all applicable laws and does not infringe anyone else's rights.
Listing on Yacht Junky is currently free. We reserve the right to introduce fees in the future, with notice provided before any charges apply to you.
5. Moderation and Removal
All listings are reviewed before they go live. We reserve the right, at our sole discretion and without notice, to reject, edit, hide, or remove any listing or content that:
Breaches these Terms or any applicable law.
Contains inaccurate, misleading, or incomplete information.
We consider inappropriate, fraudulent, or harmful to the Platform or its users.
We are under no obligation to publish any listing, and review does not constitute any verification, endorsement, or guarantee of a listing or its accuracy.
6. Buyer Responsibilities
If you contact a seller or pursue a purchase through the Platform, you are responsible for:
Independently verifying all details of the boat and the seller.
Arranging your own inspections, surveys, and sea trials.
Confirming ownership and the absence of outstanding finance or legal claims.
Agreeing terms and arranging payment directly and securely with the seller.
7. Prohibited Conduct
You agree not to:
Post false, misleading, fraudulent, or unlawful content.
List boats you do not own or are not authorised to sell.
Use the Platform to harass, defraud, or harm other users.
Scrape, copy, or harvest data or listings from the Platform without permission.
Attempt to interfere with, disrupt, or gain unauthorised access to the Platform.
Use the Platform for any purpose other than its intended use as a boat marketplace.
8. Enquiries and Communication
The Platform provides tools for buyers and sellers to contact one another. You are responsible for the content of any message you send. Yacht Junky does not monitor private communications between users and is not responsible for their content or outcome.
9. Intellectual Property
The Platform, including its design, branding, text, and software, is owned by Yacht Junky and protected by intellectual property laws. You may not copy, reproduce, or reuse any part of the Platform without our written permission.
By uploading content to a listing, you grant Yacht Junky a non-exclusive, royalty-free licence to display and use that content for the purpose of operating and promoting the Platform.
10. Limitation of Liability
The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law:
Yacht Junky is not liable for any loss or damage arising from a transaction between a buyer and a seller, including disputes, misrepresentation, defects, or failure to complete a sale.
We are not liable for the accuracy, quality, safety, or legality of any boat listed.
We are not liable for the conduct of any user, whether online or offline.
We do not guarantee that the Platform will be uninterrupted, error-free, or secure.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded under UK law.
11. Indemnity
You agree to indemnify and hold Yacht Junky harmless from any claims, losses, or costs arising from your use of the Platform, your listings or content, your transactions with other users, or your breach of these Terms.
12. Privacy
Your use of the Platform is also governed by our Privacy Policy, which explains how we collect and handle your personal data. By using the Platform, you consent to that processing.
13. Termination
You may close your account at any time. We may suspend or terminate your access to the Platform if you breach these Terms or if we consider it necessary to protect the Platform or its users. Provisions that by their nature should survive termination will continue to apply.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the effective date above. Significant changes will be communicated where appropriate. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
